This panel will discuss recent developments in the EU, UK, US and China as regards the competitive assessment and comparative remedies involving tech mergers, in particular such deals as Microsoft/Activision, Adobe/Figma and Amazon/iRobot. The panel will also discuss the proposed major overhaul of the HSR filing process.

This roundtable will focus on whether existing assessment tools are sufficient to curb the excesses of dominant firms. In particular, the speakers will discuss the effectiveness of the as-efficient-competitor test in light of the EU’s Intel, Qualcomm and Google/Android cases, as well as the recent ECJ judgment against Facebook on the relevance of GDPR to Art. 102. The speakers will also discuss the EU’s forthcoming 2024 guidelines on exclusionary abuses.

This panel will discuss the EU Foreign Subsidies Regulation (FSR) and, in particular, the Commission’s recent guidelines, as well as ex officio case developments. The discussion will then turn to the initiatives being taken by the US and EU to restrict outbound investment.
