The China Institute of International Antitrust and Investment (CIIAI) is currently planning to host a three-part antitrust webinar on 7-9 November 2022, Day One starting at 12:30 CET (19:30 China time), while Days Two and Three start at 13:00 CET (20:00 China time). These events will take place on the Zoom conferencing platform. In a compact format, we will provide the latest antitrust developments on the Interaction of FDI and Antitrust.
中国政法大学中国国际反垄断和投资研究中心将于2022年11月7日至9日在Zoom上举办为期三天的国际反垄断网络研讨会，第一天于欧洲中部时间12:30（北京时间19:30）开始，第二天和第三天于欧洲中部时间13:00（北京时间20:00）开始，研讨会将就外国直接投资和反垄断的相互作用进行讨论。

This panel will focus on the scope, processes and impact of the Committee on Foreign Investment in the United States (CFIUS) and the EU’s 2019 framework for the screening of FDI, as well as discusses methodologies for approaching such reviews. The panel will also discuss the EU’s political agreement on a new Foreign Subsidies Regulation, which is intended to level the EU playing field as regards firms which are able to distort or prevent competition in the internal market as the result of foreign subsidies that they receive.

On 13 July 2022, in its judgment in Illumina v. Commission, the EU General Court affirmed the Commission’s use of EU Merger Regulation Article 22 to review mergers falling below not only the EUMR thresholds, but also those of the Member States. “Killer” acquisitions, that is, strategic acquisitions of start-ups by tech giants, are now fair game for antitrust merger enforcement in the EU, China and the US. But what are the circumstances likely to trigger such reviews, and once triggered, what can the parties expect in terms of the procedure and substantive analysis?

This panel will discuss the jurisdictional options for setting global FRAND rates on standard-essential patents (SEPs), including the China Supreme People’s Court (Oppo v. Sharp) and the Paris High Court (Philips v. Xiaomi); as well as the EU’s proposed new framework for SEPs and the DOJ’s draft SEP policy. The panel will also discuss the FRAND licensing of data under the DMA.

This panel will discuss initiatives in the EU, US and China aimed at curbing the power of the internet giants, including the EU’s Digital Markets Act (DMA), the US’s draft Open App Markets Act and SAMR’s Guidelines for the Internet Economy. The principal questions are, what are these initiatives intending to achieve and are they likely to produce, or are they already producing, their intended pro-competitive effects? Or are these initiatives more likely to have adverse unintended consequences?
