procedure?
Due to length of many Commission investigations, decisions in fast-moving tech markets risk being ineffective. There is growing pressure on the EU to make it easier for companies to obtain interim measures in Article 102 cases. This panel will review theIMSandBroadcomcases as well as the current initiatives in the EU Member States, and will explore how this procedure may be used to prevent irreparable harm pending a final decision.

A risk in the current political and economic climate is that antitrust authorities will be forced to accept state subsidies. This panel will discuss the state of play in the EU, US and China and whether there is a risk that such measures will be enforced less aggressively in order to bolster certain sectors or companies.

09:00 -10:30 Relevant market analysis for the digital economy
The recent European cases againstGoogleandFacebookindicate that
traditional market definition analysis may be unworkable when applied to
two-sided online platforms and social networks. The April 2019 EU
Commission Report on “Competition Policy for the Digital Era” suggested
alternatives to the SSNIP test, such as SSNDQ (small but significant non-
transitory decrease in quality), and a test based on service functionalities.
This panel will discuss how antitrust enforcers are dealing with these new
challenges.
数字经济的相关市场分析

This panel will focus on recent cases such as the EU Commission’s predatory
pricing decision against Qualcomm, the Dusseldorf court suspension of the
Facebook decision, the differing positions of the FTC and DOJ in US
proceedings against Qualcomm, the new US investigations of Google and
Facebook, and the current investigation of Amazon as regards the leveraging
of its dominant position via the use of competitively sensitive data.

DOJ and FTC which may suggest a shift in approach. The panel will also
explore why vertical mergers in the ICT sector seem to be drawing particular
regulatory scrutiny, as suggested in a June 2019 OECD report.
