The China Institute of International Antitrust and Investment(CIIAI) successfully held a webinar May 9-10, 2023. The webinar discussed the latest developments on the EU frameworks for foreign subsidies and foreign direct investment.

中国政法大学中国国际反垄断和投资研究中心于2023年5月9日至10日成功举办网络研讨会，研讨会就欧盟外国补贴和外国直接投资框架展开讨论。

This panel will discuss two EU-level regimes now in place which regulate foreign subsidies and foreign direct investment (FDI). The EU Foreign Subsidies Regulation (FSR), which goes live on 12 July 2023, addresses distortions to competition in the EU internal market arising from the receipt of foreign subsidies. Such recipients involved EU acquisitions or public procurement are potentially subject to EU reporting requirements and investigation. The 2019 EU Regulation for the FDI screening establishes a framework for the adoption by the Member States of national FDI screening legislation and enforcement in sensitive sectors having national security concerns.

本小组将讨论欧盟现有的两个监管外国补贴和外国直接投资（FDI）的制度。欧盟《外国补贴条例》（FSR）将于2023年7月12日生效，旨在解决外国补贴对欧盟内部市场的竞争产生的扭曲。获得外国补贴的企业在欧盟从事并购交易、竞标公共采购项目可能需要进行申报和接受调查。2019年欧盟《外国直接投资审查条例》为成员国通过国家外国直接投资审查立法和在涉及国家安全的敏感行业的执法方面确立了一个框架。

This panel will focus on the practicalities of dealing with FSR reporting requirements, how to determine, using the existing State aid rules as guidance, whether the public subsidy in question creates, or is likely to create, a distortion to competition, as well as the company’s rights and potential defenses in the context of an FSR investigation.

本小组将重点讨论应对FSR申报要求的实际问题，如何以现有的国家援助规则为指导，确定有关的公共补贴是否造成或可能造成对竞争的扭曲，以及公司在FSR调查中的权利和潜在的辩护措施。

This panel will focus on the FDI screening regimes of three of the leading European countries for Chinese tech investment, France, Germany and the UK. The panel will discuss the relevant national legislation and in particular, the sectors that are subject to FDI screening, the criteria applied in ministerial reviews, how to prepare a notification to the ministries carrying out FDI screening, the rights and defenses available to investors, as well as the nature and extent of ministerial coordination with the European Commission.

本小组将重点讨论法国、德国和英国这三个中国科技投资的主要欧洲国家的外国直接投资审查制度。该小组将讨论相关的国家立法，特别是接受外国直接投资审查的产业，部级审查中适用的标准，如何向外国直接投资审查的部门进行申报，投资者享有的权利和可用的辩护，以及与欧盟委员会的部级协调的性质和程度。
